Credit Application

I hereby certify that the information contained herein is complete and accurate. This information has been furnished with the understanding that it is to be used to determine the amount and conditions of the credit to be extended. Furthermore, I hereby authorize the financial institutions listed in this credit application to release information for the business for which credit is being applied for, including personal information, in order to verify the information contained herein. I hereby acknowledge, consent, and agree that the personal information in this credit application along with any personal information obtained from a financial institution or credit/consumer reporting agency may be used by AmChar Canada, Inc., for the purpose of evaluating the applicant’s eligibility for credit and for collection purposes if necessary.

I further understood and expressly agree that any and all sales and transactions with the business named herein which occur after approval of this credit application are subject to the provisions of the Terms and Conditions of Sale of AmChar Canada, Inc. as set forth therein, a copy of which I acknowledge has been provided me or which accompanies this credit application. I acknowledge a copy is also available to the business and myself at any time upon request and that such Terms and Conditions of Sale are specifically incorporated in full into this credit application by this reference. I and the business for which this credit application is being submitted agree to be bound thereby as if it and I had directly executed and consented to the same. AmChar Canada. Inc. shall be entitled to rely upon the acceptance of such Terms and Conditions of Sale in connection with any sale made by it hereafter.

I hereby execute this credit application on behalf of the above-named business and personally guarantee, and agree to be personally liable for failure of the performance by the business named herein, of any and all of its obligations to AmChar Canada, Inc., including timely payment of any and all sums due AmChar Canada, Inc. This personal guarantee will specifically apply in the event that the business for which credit is being applied for declares bankruptcy or files for bankruptcy protection.

I personally and individually and my business hereby agree to each and all of the foregoing by signing and submitting this Credit Application.

This Credit Application may be executed in multiple counterparts by the parties hereto. All counterparts so executed shall constitute one agreement binding upon all parties, notwithstanding that all parties are not signatories to the original or the same counterpart. Each counterpart shall be deemed an original to this Credit Application, all of which shall constitute one agreement to be valid as of the date of this Credit Application. Documents executed, scanned and transmitted electronically and electronic signatures shall be deemed original signatures for purposes of this Credit Application and all matters related thereto, with such scanned and electronic signatures having the same legal effect as original signatures.
